I. General information

The confidentiality of your personal data is one of the main concerns of Best Topo Solutions SRL, as a data controller. This document is intended to inform you about the processing of your personal data in the context of the use of the website https://www.3dmaps.ro/

II. Categories of personal data processed

II.1. If you are a customer of the Site, the website owner will process your personal data, such as first and last name, telephone, e-mail address, billing address, delivery address, data concerning the way you use the Site, for example your behaviour / preferences / habits within the website owner's services, as well as any other categories of data that you provide directly when creating a user account, when placing an order through the site or in any other manner resulting from the use of the Site.

If, in order to create a user account on the Site, you use your Facebook or Google account, the website owner will process the following public profile data displayed by those applications: user name, e-mail address.

If you choose to create a user account only before completing an order for a product available on the Site, your e-mail address will be requested and an account will be created automatically based on it. If you do not complete the order, the e-mail address and the other data provided will not be stored by the website owner, and the account created will be deleted automatically.

II.2. If you are a visitor to the Site, the website owner will process your personal data that you provide directly in the context of the use of the Site, such as the data you provide in the contact / questions / complaints section, to the extent that you contact us in this way.

III. Purposes and legal grounds for processing

III.1. If you are a customer of the Site, the website owner processes your personal data as follows:

  • to carry out the contractual relationship between you and the website owner, namely to take up, validate, ship and invoice the order placed on the Site, to inform you of the status of the order, to organise the return of ordered products, etc.
    Legal basis: The processing of your data for this purpose is based on the contract concluded between you and the website owner. The provision of your personal data is necessary for the performance of this contract. Refusal to provide the data may make it impossible to carry on the contractual relationship between you and the website owner.
  • for the fulfilment of the legal obligations incumbent on the website owner in the context of the services provided through the Site, including obligations in tax and archiving matters.
    Legal basis: The processing of your data for this purpose is required on the basis of legal obligations. The provision of your data for this purpose is necessary. Refusal to provide the data may make it impossible for the website owner to comply with its legal obligations and therefore impossible to offer you the services through the Site.
  • for marketing activities, namely for the transmission, by means of distance communication (e-mail, SMS), of commercial communications regarding the products and services offered by the website owner, through the Site.
    Legal basis: The processing of your data for this purpose is based on your consent, if you choose to provide it.
    You may express your consent to the processing of data for this purpose by ticking the corresponding box when creating your account, or after creating your account, in the "My account information" section. To unsubscribe from receiving such commercial communications you may use the option at the end of each commercial e-mail/SMS.     Provision of your data for this purpose is voluntary. Refusal to consent to the processing of your data for this purpose will not have any negative consequences for you.
  • for the purpose of carrying out various analyses, reports on the way the Site works, profiling of consumer preferences, mainly with a view to improving the experience offered on the Site.
    Legal basis: The processing of your data for this purpose is based on the website owner's legitimate interest in continuously improving the customer experience on the Site. The provision of your data for this purpose is voluntary. Refusal to provide data for this purpose will not have any negative consequences for you.

III.2. If you are a visitor to the Site, the website owner processes your personal data as follows:

  • for marketing activities, namely for the transmission, by means of distance communication (e-mail, SMS), of commercial communications regarding the products and services offered by the website owner, through the Site.
    Legal basis: The processing of your data for this purpose is based on your consent, if you choose to provide it.
    You may express your consent to the processing of data for this purpose by filling in and ticking the corresponding box in the newsletter subscription form available on the Site. To unsubscribe from receiving such commercial communications you may use the option at the end of each commercial e-mail/SMS.
    Provision of your data for this purpose is voluntary. Refusal to consent to the processing of your data for this purpose will not have any negative consequences for you.
  • to resolve complaints, claims and to monitor traffic and improve your experience on the Site.
    Legal basis: The processing of your data for this purpose is based on the website owner's legitimate interest in ensuring the proper functioning of the Site, as well as in continuously improving the experience of the Site's visitors, including by resolving various comments, questions or complaints.
    Provision of your data for this purpose is voluntary. Refusal to provide data for this purpose will not have any negative consequences for you.

IV. The duration for which we process your data

As a matter of principle, the website owner will process your personal data for as long as necessary to fulfil the processing purposes set out above.

If you are a customer, we will process your data for the entire duration of the contractual relationship and afterwards according to the legal obligations incumbent on the website owner (e.g. in the case of financial-accounting supporting documents, for which the legal retention period is 10 years from the end of the financial year in which they were drawn up).

Should you be a customer and exercise your option to delete your user account by pressing the "Delete account" button in the "My account information" section, the website owner will interpret this action as your choice to unsubscribe from commercial communications by which we keep you up to date on the products and services offered through the site. In this respect, if you choose to delete your user account, we will no longer send you e-mails and/or SMS messages of this nature. However, please note that the deletion of the account will not automatically result in the deletion of your personal data. If you no longer wish your personal data to be processed or if you wish your data to be deleted, you may exercise your rights as detailed in point VII below. If you request the deletion of the account, but there is at least one active order on that account, the request to delete the account may only be registered after the products are delivered and the last active order is completed.

If you withdraw your consent to the processing of data for marketing purposes, the website owner will cease processing your personal data for this purpose, without however affecting the processing carried out by the website owner on the basis of consent given by you prior to its withdrawal.

V. Disclosure of personal data

In order to fulfil the processing purposes, the website owner may disclose your data to partners, third parties or entities that support the website owner in carrying on its activity through the Site (for example courier companies, IT service providers), or to central/local public authorities, in the following cases listed by way of example:

  • for the administration of the Site;
  • in cases where such communication is necessary for the awarding of prizes or other benefits to the data subjects, obtained as a result of their participation in various promotional campaigns organised by the website owner through the Site;
  • for the maintenance, customisation and improvement of the Site and the services carried out through it;
  • to carry out data analysis, testing and research, monitoring of usage and activity trends, development of security features and user authentication;
  • for the transmission of marketing commercial communications, under the conditions and within the limits provided by law;
  • where the disclosure of personal data is required by law, etc.

VI. Transfer of personal data

Personal data provided to the website owner may be transferred outside Romania, but only to states within the European Union.

VII. The rights you have

Under the conditions provided by the legislation on the processing of personal data, as data subjects you have the following rights:

  • the right to information, namely the right to receive details on the processing activities carried out by the website owner, as described in this document;
  • the right of access to data, namely the right to obtain confirmation from the website owner as to the processing of personal data, as well as details on the processing activities, such as the way in which the data are processed, the purpose of the processing, the recipients or categories of recipients of the data, etc.;
  • the right to rectification, namely the right to obtain the correction, without undue delay, by the website owner, of inaccurate / unjustified personal data, as well as the completion of incomplete data. The rectification / completion will be communicated to each recipient to whom the data have been sent, except where this proves impossible or involves disproportionate effort.
  • the right to erasure of data, without undue delay ("right to be forgotten"), in cases where one of the following reasons applies:
    • they are no longer necessary for the fulfilment of the purposes for which they were collected or processed;
    • where consent is withdrawn and there is no other legal basis for processing;
    • where the data subject objects to the processing and there are no overriding legitimate grounds;
    • where the personal data have been unlawfully processed;
    • where the personal data must be erased for compliance with a legal obligation;
    • the personal data have been collected in connection with the offering of information society services under EU or national law to which the operator is subject.
    It is possible that, following the request for erasure of the data, the website owner may anonymise such data (thus removing their personal character) and continue processing under those conditions for statistical purposes;
  • the right to restriction of processing, where:
    • the person contests the accuracy of the data, for a period allowing us to verify their accuracy;
    • processing is unlawful and the data subject opposes the erasure of the personal data, requesting instead the restriction of their use;
    • the operator no longer needs the personal data for processing purposes, but the data subject requests it for the establishment, exercise or defence of a right in court; or
    • the data subject has objected to processing (other than direct marketing), for the period of time during which it is checked whether the legitimate rights of the operator override those of the data subject.
  • the right to data portability, namely (i) the right to receive personal data in a structured, commonly used and machine-readable format, and (ii) the right to have such data transmitted by the website owner to another data controller, to the extent that the conditions provided by law are met;
  • the right to object — with regard to the processing activities, this may be exercised by submitting a request as indicated below;
    • at any time, on grounds relating to the particular situation in which the data subject finds himself, that data concerning him or her be processed on the basis of the website owner's legitimate interest or on the basis of public interest, except where the website owner can demonstrate that it has legitimate and compelling grounds justifying the processing and overriding the interests, rights and freedoms of the data subjects, or that the purpose is the establishment, exercise or defence of a right in court;
    • at any time, free of charge and without any justification, that data concerning him or her be processed for direct marketing purposes.
  • the right not to be subject to an individual automated decision, namely the right not to be the subject of a decision based solely on automated processing activities, including profiling, which produces legal effects concerning the data subject or significantly affects him or her in a similar way;
  • the right to address the National Supervisory Authority for Personal Data Processing (ANSPDCP) or the competent courts, to the extent that you consider it necessary.
